Owners Of Olympia Restaurant Sue State Over Landslide Damage

KIRO-TV has learned the owners of the Ranch House BBQ restaurant have filed a $2.5 million claim against the state Department of Natural Resources.

The restaurant located west of Olympia on Highway 8 was destroyed on Dec. 3, 2007, when a massive wall of mud and debris came barreling down the hillside and through the Ranch House building.

In their claim, the owners allege that the state failed to properly maintain the state-owned land above the restaurant resulting in the landslide during last December’s storm.

In addition to monetary damages, the restaurant owners say the claim also demands the state take action to ensure the hillside is stabilized.

“Everything backed up behind their bridge and their bridge actually broke in two and came through our property and landed on our property," said Ranch House owner Melanie Tapia.

Tapia says they will file the lawsuit on Dec. 3 -- the one year anniversary of the storm.

Officials from the state attorney general's office told KIRO 7 that they are currently reviewing the claim against the state and cannot make any comments at this time.

In addition to the lawsuit, the Ranch House owners are dealing with another setback in their plans to reopen the restaurant.

Apparently set off by some hot roofing materials, a fire destroyed the roof of the rebuilt restaurant Sunday.

Despite the setback, the owners said construction crews will be working double shifts in an effort to get the original Ranch House BBQ location reopened before the end of the year.

The restaurant has been opened in a temporary location in downtown Olympia, but that location will shut down at the end of this month and employees will face a temporary layoff until the new location can open.
