Family Says 'Intoxicated' Baby Was Not On Drugs

The mother of a 10-month-old baby who police found to be intoxicated said the incident is a misunderstanding and that the child had no drugs in his system.

Officers responding to a complaint of someone fighting found Naomi Chavez drunk and that there were drugs in her system, police said.

Police said her child, Rafael, was not responding normally and they took the baby to Children's Hospital, where he was evaluated and handed to Child Protective Services.

"No, he did not have (any) drugs in his system," Naomi Chavez told KIRO 7 Eyewitness News reporter David Quinlan. "It was because I was drinking and I feed my baby, and that was something I did."

Lillian Chavez, Rafael's grandmother, said the baby is doing fine. She said she'll be getting Rafael on Thursday after CPS wraps up its investigation.

"The baby didn't have (any) drugs and even no alcohol. He just had a skin rash," Lillian Chavez said.

Naomi Chavez said the incident was a wake-up call and that she plans to get help for her drinking.

"I made a mistake and it's going get fixed. They said alcohol was a factor. I should've been a smarter person and not be feeding him under the influence," she said.

The case remains under investigation. CPS said will not confirm whether or not the baby was intoxicated and whether or not he will be released to his grandmother. He remains in protective custody.
