Judge denies custody to Josh Powell as new allegations emerge

TACOMA, Wash. —

A judge said the children of missing Utah mother Susan Cox Powell will remain in the custody of her parents amid new allegations that sexually explicit images were found on a home computer belonging to their father, Josh Powell.


More than two years after his wife vanished, Josh Powell has come under increased scrutiny because of child porn allegations against his father -- and now because of questions about his own behavior, said KIRO 7 Eyewitness News reporter Kevin McCarty, who attended a court hearing Wednesday regarding custody of the couple's two boys.


Allegations of sexually explicit images found on one of Powell's home computers more than two years ago have caused the Department of Social and Health Services to ask more questions about what had been going on in his home.


"This is something that's been a concern," said John Long of the Attorney General's Office. "I mean, the original dependency petition that was filed in this case was filed because there was child pornography in that home."

Pierce County Superior Court Judge Kathryn J. Nelson ruled Powell must undergo a psychosexual evaluation and polygraph test, noting the "extreme child porn" found in the Puyallup home where Josh was living with the two boys and his parents after Susan's disappearance.

An attorney for Powell described the images as "in bad taste" but not illegal, and said Powell should be granted custody of his two young boys.


"I've got a client who's been very timely, very diligent -- done everything they've asked him to do," said Jeff Bassett, Powell's attorney.


Susan Powell vanished in December of 2009.


For now, her parents retain custody of the boys.

"We're relieved that the children will be with us, for now," said Chuck Cox, her father.

Josh Powell can continue to see his sons on supervised visits several times a week.

He will undergo counseling, a psychosexual evaluation and a lie detector test before the next custody hearing, scheduled for late July.
