Men Convicted In 1994 Bellevue Slayings To Get Appeal Hearing



SEATTLE —

An appeal will be heard next week in the case of two men convincted in the 1994 slaying of a Bellevue family, and on Wednesday, family of one of the men said they're convinced it could turn the case around.

Sebastian Burns and Atif Rafay were convicted in the beating deaths of Rafay's family and are each serving three life terms without parole.

Burns' sister, Tiffany, was in Seattle on Wednesday to screen a film she produced about the Canadian sting operation that led to her brother's arrest.

"It just seems so obvious to me -- the evidence is there; the facts of the case are there (that) they didn't do this crime," Tiffany Burns said.

During the sting used by Canadian police, and called "Mr. Big," an undercover officer poses as a mob boss and lures a suspect into an eventual confession. A recording of Sebastian Burns and Rafay confession to an undercover officer in such an operation was shown at their trial in 2003.

"Yes, they get guilty people, but they get innocent people who are really, really worred that now they are messed up with the wrong characters and (are thinking), 'I better say whatever this guy wants to hear,'" Tiffany Burns said.

The video of Sebastian Burns and Rafay confessing was key evidence that led to the men's sentences.

"This isn't persuasion, this is downright coercion," said David Burns, Tiffany and Sebastian's father.

DNA expert Dr. Greg Hampikian, who also helped get an appeal hearing for Amanda Knox, said he's hoping DNA will also play a key role in the July 8 appeal.

"There is additional evidence that could now be tested with newer techniques that will allow us to develop profiles from other items that were not tested at the time," Hampikian said.
