No Charges Filed Against Suspended Teacher



SEATTLE —

A Seattle teacher will not face criminal charges for allegedly hitting two students five months ago. Seattle City Attorney Tom Carr said Wednesday there was not enough evidence to file charges against the teacher. Carr made the conclusion after a five-month review of the case against the 57-year-old physical education teacher at Hawthorne Elementary School who is accused of using excessive force while trying to stop an argument between two fifth graders. Carr said his decision was based, in part, on state law.

“There’s a state statue that provides a certain immunity for parents and teachers to use reasonable discipline to control a situation,” said Carr. Carr said the only witnesses were other students whose stories differed.

Parents Shannon King and Ruthetta McGee told KIRO in April that they felt the teacher had gone too far.

“She (the teacher) went into her office, got a yard stick and came out and whacked my son,” said King.

Officials said the teacher has been on paid administrative leave from the Seattle School District since March and that she will remain on leave until the district completes its investigation.
